The accusation being made is one of misinformation, namely fraudulent claims by Lindsay that StC accepted the donation, which they are claiming they didn't (once all the information became available to them.) They are correct--once they realized who Lindsay and I represented, the money was returned. Likewise, they are claiming (correctly, I assume) that Lindsay used the StC charity's name on his website without express written permission. So, it isn't about free speech here--it's about libel and misuse of the StC name.
