The decision is just. Say for example I was permitted to represent the absent class members pro se, and the State offered to end the persecution of my family if I agreed to sabotage the class claims by allowing the State to create a separate and unequal class of people. What would a reasonable person do?
This is the reason why class counsel must be adequate.
fund-raising for counsel is not currently practical, although it would take less than ten dollars per minor-attracted individual in Indianapolis to raise the necessary amount for a retainer ($50,000).
