In that sense, not really. But it is the same thing as happens with rights which are there on paper but limited by, for instance, the financial capabilities of the parents or a disability the child has.

Though I personally doubt that any child but the most actually problematic (whose problems are not going to be solved by changing households anyway) would fail to find takers in a world that did not punish this.
