By and large, the ACLU doesn't deal with private enterprises that discriminate unless a law is broken.

They do make exceptions for some public accommodations such as restaurants, but generally only if there are laws on the books prohibiting the discrimination. In other words, they may help you sue Denny's restaurants for racial discrimination, but they won't help you sue Joe's Private Club for the same thing.
