A person cannot know what the other person is thinking when the other person says or shows something that looks like they are consenting. To know for sure demands telepathy. A person cannot know, even for itself, the consequences of the acts they think they consent to. When people take a vehicle, they don't know the vehicle is going to have an accident which will kill them. To know for sure demands clairvoyance. For everyone who is not a psychic, consent is a superhuman ability which only exists in philosophical speculation in the same places as the attributes of gods of omniscience, omnipotence, omnibenevolence, and all others that follow. The only thing you have in the real world is compliance or resistance. That is evident, and it can be measured and it can be shown to others not originally present. Either of them can. Everything else, outside of real physical compliance or resistance, is idle philosophical speculation. And fixating on it as we do in CL circles is religious dogma. No, children cannot consent. At all. And neither can you. And neither can anyone. Other than gods and telepathic clairvoyants. You know a lot about comics. Maybe there is a superhero Consent Man, who is a telepathic clairvoyant? |
