Liabilities as such are creations of government action. In "natural market incentives", liabilities fall neither to the industry nor to government/everyone as taxpayer, but rather to people who have the misfortune to be affected.
It might not be universal, but commercial misconduct is certainly one of the oldest and most generalized offences in law.
Of course, go back far enough and you don't even find an obligation to pay. You find that those affected simply take your life.
