I understand what you are saying, but I believe that whenever possible, the state should act to preserve democratic rights. Many liberals are fighting for state sanctioned recognition of gay marriage, and this is indeed a case where they are asking for the state to sanctify and protect their rights rather than denying it or simply staying out of it. There are instances when the state should indeed stay out of our personal lives, but when it comes to the enforcement of civil rights and protecting us from demonstrable harm that is outside of our consent, then I do think that as long as a class ruled society continues to exist, we have no choice but to depend on the ruling class (and we both know that the state is an instrument of the ruling class) to preserve order. Moreover, it's not unreasonable or in any way undemocratic to insist that the state enforces civil rights, because without the state doing so, anyone can violate those rights with impunity. When those two gay men were arrested a few years ago in Texas when they were discovered having sex in the privacy of their own home, they appealed to the Supreme Court to protect their rights as "consenting adults." So even as they fought against agents of the state interfering in their right to mutually consensual intimacy, they subsequently turned to the state in enforcing that right. It can work both ways.
